Wedding Videography Contract

 

The legal bit.

This Wedding Videography Contract helps clarify expectations and ensures we’re both protected. Once you have read and agreed to the terms and conditions, please tick the box at the bottom of the page and enter the date as confirmation of contract acceptance. Once this has been received, I will send a deposit payment invoice via my accountancy software and the date is yours! Good times ahead.

ENTIRE AGREEMENT: This agreement contains the entire understanding between THOMAS SMITH and THE CLIENT. It supersedes all prior and simultaneous agreements between the parties. It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both THOMAS SMITH and THE CLIENT, in writing.

1. DEPOSIT PAYMENT: THOMAS SMITH will reserve the date agreed upon, and will not make other reservations for that date. For this reason, a 20% deposit payment of £XXX is to be paid at time of signing the contract. The deposit is applied towards the contracted wedding film package.

2. REMAINING BALANCE: THE CLIENT understands and agrees that the remaining balance of £XXX owed for the wedding film package described in the contract is due two weeks prior to the wedding date.

3. CREATIVE LICENCE: THOMAS SMITH shall be granted creative and artistic license in relation to capturing and editing the wedding film. Judgement on film style shall be deemed correct. THE CLIENT acknowledges that they are familiar with THOMAS SMITH’s portfolio and are requesting services with knowledge of THOMAS SMITH's style; that THOMAS SMITH's work is constantly evolving; that THOMAS SMITH’s services are of unique and artistic nature; and that in creating the wedding film, THOMAS SMITH shall use his personal artistic judgment to create moving images consistent with his personal vision of the event.

4. EXCLUSIVITY: THOMAS SMITH shall be the sole professional videographer at the venues specified. THOMAS SMITH however positively encourages family, friends, and other guests to take photographs and videos throughout the day.

5. COPYRIGHT LAW: The copyright of the film remains with THOMAS SMITH. THOMAS SMITH grants THE CLIENT permission to download and share the film under the following conditions. The film produced by THOMAS SMITH is for personal use by THE CLIENT and their friends and relatives. Sale, publication or any commercial use of the film is not allowed without prior written permission from THOMAS SMITH. THE CLIENT must obtain written permission from, and compensate THOMAS SMITH prior to an event where THE CLIENT, THE CLIENT’s friends or relatives publish or sell the film for profit.

6. RELEASE: THE CLIENT hereby grants THOMAS SMITH the irrevocable and unrestricted right to publish the wedding film for editorial, trade, advertising or any other purpose and in any manner and/or medium considered standard by the wedding industry. Such mediums/purposes include, but are not limited to: advertising, internet promotion, wedding fairs, and any other use thought proper by THOMAS SMITH and considered standard by the wedding industry.

7. FORCE MAJEURE: THOMAS SMITH makes every effort to produce the high quality films, including using professional grade equipment, and professional grade backup equipment. However, in the unlikely event of total equipment failure, injury or sickness beyond THOMAS SMITH’s control, liability shall be limited to a full refund of all monies paid, including the deposit. The limit of liability shall not exceed the contract price stated herein. THOMAS SMITH has full Public Liability Insurance.

8. VIDEOGRAPHER CANCELLATION: In the unlikely event that THOMAS SMITH has to cancel this contract for reasons beyond his control, (death, injury, sickness, or other circumstances beyond the control of the videographer etc.) a substitute videographer of similar skill, style, pricing, and product offerings may be sent to fulfill the obligations of the videographer herein contracted. If a substitute videographer is provided, THE CLIENT has the right to refuse to accept the substitute videographer and may instead terminate this agreement and receive a full refund of all monies paid, including the deposit.

9a. CLIENT CANCELLATION: As compensation for loss of income for THOMAS SMITH, the following charges apply as a percentage of the total fee due.

(Number of days before the wedding): 0-30 days = 100%, 31-60 days = 75%, 61-90 days = 50%, 90-120 days = 25%, 121+ days = 0%

If you, THE CLIENT, cancel your contracted wedding film services with THOMAS SMITH, your deposit is refundable provided THOMAS SMITH has not turned away any other weddings for your wedding date. Should the cancelled wedding turn out to be a postponement, then, subject to availability, all money paid may be applied to the new wedding. In this case, the total fees chargeable shall be the fee which applies at that time.

9b. CORONAVIRUS: If you, THE CLIENT, are forced to postpone and reschedule the wedding due to Coronavirus, you will be allowed to do so at no extra cost. If THOMAS SMITH is not available for the new wedding date, THE CLIENT will be entitled to a full refund of monies paid, including the deposit.

10. COMPLETION SCHEDULE: Wedding film editing takes approximately 4-6 weeks. When THOMAS SMITH has finished editing the wedding film, the wedding film will be uploaded to an online video sharing platform for unlimited time. THE CLIENT will be able to share and download without limit.
